1. Introduction & Acceptance
GetViral.Digital (the "Platform") is owned and operated by Clicksilo Digital Marketing Inc. By accessing, browsing, or creating an account, you (the "User") agree to be legally bound by these Terms. If you do not agree to every provision, you are strictly prohibited from using the platform and must exit immediately.
2. Eligibility & Account Security
- Age: You must be at least 18 years of age (or the age of majority in your jurisdiction) to use this Platform.
- Credentials: You are solely responsible for maintaining the confidentiality of your login credentials (e.g., email/password). Any activity occurring under your account is your legal responsibility.
- Termination: We reserve the right to suspend or terminate accounts at our sole discretion, without notice, for any conduct we deem harmful to the platform or other users.
3. User-Generated Content (UGC) & "Submit a Tip"
As a social platform, GetViral.Digital facilitates the sharing of media and information ("Intel").
- Responsibility: You are solely responsible for the content you post. You represent that you own or have the necessary licenses for all media submitted.
- License Grant: By posting content, you grant Clicksilo Digital Marketing Inc. a perpetual, worldwide, royalty-free, irrevocable license to use, host, store, reproduce, modify, and distribute your content across any current or future media channels.
- No Verification: While we provide the "Command Center" for information, we do not guarantee the accuracy, integrity, or quality of User-Generated Content. You use the information on this site at your own risk.
4. Prohibited Conduct & Community Standards
To avoid litigation and maintain safety, you agree NOT to:
- Post "Doxxing" information (private addresses, phone numbers, or private documents of individuals).
- Submit content that is defamatory, libelous, or constitutes hate speech under Canadian law.
- Upload media that infringes on third-party intellectual property or privacy rights.
- Use the platform to coordinate illegal acts or incite violence.
- Automation: Use bots, scrapers, or AI to harvest data from the platform without written consent from Clicksilo Digital Marketing Inc.
5. Absolute Limitation of Liability (The "No Litigation" Clause)
To the maximum extent permitted by law, Clicksilo Digital Marketing Inc., its directors, employees, and affiliates shall NOT be liable for:
- Any indirect, incidental, special, or consequential damages.
- Errors, inaccuracies, or omissions in any content.
- Personal injury or property damage resulting from your access to or use of the platform.
- Any unauthorized access to our secure servers or personal information stored therein.
Content Accuracy: We are a neutral service provider. We are not responsible for the "fake" or "real" status of community-submitted tips.
6. Indemnification
You agree to defend, indemnify, and hold harmless Clicksilo Digital Marketing Inc. from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt (including legal fees) arising from:
- Your use of and access to the Platform.
- Your violation of any term of these Terms of Service.
- Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
7. Disclaimer of Warranties
The platform is provided on an "AS IS" and "AS AVAILABLE" basis. Clicksilo Digital Marketing Inc. makes no warranties, expressed or implied, regarding the reliability of the service, the availability of the platform, or the safety of the content. We do not warrant that the platform will be error-free or that the servers are free of viruses.
8. Intellectual Property
All branding, logos (GetViral.Digital, Clicksilo), site design, and code are the exclusive property of Clicksilo Digital Marketing Inc. You may not replicate the "GetViral" aesthetic or brand assets for commercial use without express permission.
9. Modifications to Service and Terms
We reserve the right to change these terms at any time. Your continued use of the platform following the posting of changes constitutes your acceptance of such changes.
